Reading the whole decision of the Supreme Court, the court did not absolutely turn down same-sex marriage. In fact, the court, to some degree, declared their agreement to the very essence of the petition, that the constitution does not prohibit marriage on the basis of sexual orientation.
Important lessons can be learned by the litigant and their team as well as the whole network of LGBTQI+ organizations with this judicial exercise. There shouldn’t be any shaming or blaming at this point, but rather, a deep, meaningful and collective introspection.
Let us be reminded that some battles are lost in order to advance greater victory. There are loses that ultimately lead to our win. We may have lost this judicial battle, but in effect, the supreme court has pronounced, in essence, its favorable opinion on same sex marriage.
The relevant question now is, what do we do with it and how do we move forward?
